Dear Director Nussle:
As you know, on December 31, 2007, President Bush signed the Sudan Accountability and Divestment Act (SADA) into law. SADA contains a provision which requires that the Federal Acquisition Regulation be amended within 120 days to prohibit federal contracts from being awarded to foreign companies that are funding the genocide in Sudan. Those 120 days ended on April 29, 2008, and the Federal Contract Ban has not yet been implemented.
This is an extremely important provision of SADA, as the United States government currently has millions of dollars in federal contracts with the small group of companies that support the genocidal regime in Sudan. It is imperative that your office amends the procurement regulations in order to prevent future contracts, and the renewal of existing contracts, with these companies.
Please ensure that this happens as soon as possible. Every day that we continue to support contracts with these companies means another day that we are providing the Sudanese government with the funds they need to commit genocide against their own people.
